Terms of Use
1. Provider
FoxCount is provided by Malner Studios.
2. Scope
These Terms apply to the use of the FoxCount app and this support website.
3. License and app store terms
If you download FoxCount through the Apple App Store, Apple’s Standard End User License Agreement may also apply unless a different custom EULA is provided for the app.
4. Permitted use
FoxCount is intended for personal use as a mental math training application. Users may use the app only in compliance with applicable law and these Terms.
5. Intellectual property
The app, its design, branding, content and all related intellectual property rights remain with Malner Studios or the respective rights holders. Unless permitted by applicable law, the app may not be copied, distributed, modified, reverse engineered or used commercially without prior permission.
6. Availability and changes
FoxCount may be updated, modified or discontinued in whole or in part at any time. Features and content may change.
7. Advertising and third-party services
FoxCount may display advertisements and may use third-party services such as Google AdMob. The use of those services may be subject to separate terms and privacy policies of the respective providers.
8. No guarantee
FoxCount is provided on an “as is” and “as available” basis to the extent permitted by law. No guarantee is given that the app will be uninterrupted, error-free or available at all times.
9. Limitation of liability
To the extent permitted by law, Malner Studios shall not be liable for indirect, incidental or consequential damages arising from the use of or inability to use FoxCount. Mandatory statutory rights remain unaffected.

1. Anbieter
FoxCount wird von Malner Studios bereitgestellt.
2. Geltungsbereich
Diese Nutzungsbedingungen gelten für die Nutzung der App FoxCount sowie dieser Support-Website.
3. Lizenz und App-Store-Bedingungen
Wird FoxCount über den Apple App Store heruntergeladen, kann zusätzlich Apples Standard-Endnutzer-Lizenzvertrag gelten, sofern für die App keine abweichende Custom EULA bereitgestellt wird.
4. Zulässige Nutzung
FoxCount ist für die persönliche Nutzung als App zum Training von Kopfrechnen bestimmt. Die App darf nur im Einklang mit geltendem Recht und diesen Nutzungsbedingungen verwendet werden.
5. Geistiges Eigentum
Die App, ihr Design, Branding, ihre Inhalte und alle damit verbundenen Rechte des geistigen Eigentums verbleiben bei Malner Studios oder den jeweiligen Rechteinhabern. Soweit gesetzlich nicht erlaubt, darf die App ohne vorherige Zustimmung nicht kopiert, verbreitet, verändert, rückentwickelt oder kommerziell genutzt werden.
6. Verfügbarkeit und Änderungen
FoxCount kann jederzeit ganz oder teilweise aktualisiert, geändert oder eingestellt werden. Funktionen und Inhalte können sich ändern.
7. Werbung und Drittanbieter
FoxCount kann Werbung anzeigen und Drittanbieter-Dienste wie Google AdMob einsetzen. Für diese Dienste können ergänzend die jeweiligen Bedingungen und Datenschutzhinweise der Drittanbieter gelten.
8. Keine Gewähr
FoxCount wird im gesetzlich zulässigen Umfang „wie besehen“ und „wie verfügbar“ bereitgestellt. Es wird keine Gewähr dafür übernommen, dass die App jederzeit unterbrechungsfrei, fehlerfrei oder dauerhaft verfügbar ist.
9. Haftungsbeschränkung
Soweit gesetzlich zulässig, haftet Malner Studios nicht für mittelbare, zufällige oder Folgeschäden, die aus der Nutzung oder der Unmöglichkeit der Nutzung von FoxCount entstehen. Zwingende gesetzliche Rechte bleiben unberührt.
